Established in 1951, IOM is a Related Organization of the United Nations, and as the leading UN agency in the field of migration, works closely with governmental, intergovernmental, and non-governmental partners. IOM is dedicated to promoting humane and orderly migration for the benefit of all. It does so by providing services and advice to governments and migrants.

Context:

The decades-long conflict in Mindanao stems from the historical injustices and human rights violations, stemming from the unjust dispossession of land, territorial, and property rights of the Bangsamoro people and non-Moro IPs. Addressing community land issues in a consultative, transparent, and community-based manner is critical to peacebuilding and development efforts. A strong, evidence-based, participatory process is needed to ensure that key stakeholders such as the Ministry for Public Order and Safety (MPOS) and the Bangsamoro Human Rights Commission (BHRC) can guide Transitional Justice and Reconciliation in a manner that effectively informs land policy and programmes.

Nature of Consultancy:

The purpose of the consultancy is to provide technical assistance to the Bangsamoro Human Rights Commission (BHRC) to enhance the capacity of the staff on Transitional Justice and Reconciliation (TJR) and produce guidelines on the TJR mandate of BHRC, in contribution to achieving IOM’s objectives on the joint project on Conflict Transformation in BARMM.

IOM Project to which the Consultancy is contributing: Emergency and Post Crisis Unit

Project Context and Scope:

i. With guidance from the project team, support the conduct of a series of consultations with the BHRC and other relevant BARMM ministries.

ii. Design and manage a capacity-building program in coordination with BHRC and IOM.

iii. Draft and finalize the Guidelines on Operationalizing the TJR mandate of BHRC.

iv. Convene stakeholders for a workshop with key BHRC personnel to gather feedback and participate in further discussions with the BHRC and/or other relevant actors to present consolidated results.

These services shall be provided by the consultant, working on a hybrid modality (writing and research work, as well as some meetings to be held online; other activities may be conducted in person if circumstances permit) during a period of four (4) months, starting from July 2023 to October 2023. Conduct of any face-to-face activities is understood to be subject to observance of applicable health protocols and to any movement restrictions that may be imposed by the Philippine government.

Realistic Delivery Dates and Details as to how the work must be delivered

Category B Consultant hired to deliver a report on a three-instalment payment basis:

Deliverables are to be performed in accordance with the following indicative schedule and may adjust upon further deliberation.

1. First deliverable: Report outlining the results of the desk review and consultation meetings with BHRC, and proposed work plan (First Instalment Payment: 30%)

o July 1-15, 2023 – desk research, meetings with the project team and BHRC; preparatory coordination for the training and workshop

o July 16, 2023 – submission of program design for the training

o July 17-20, 2023 – preparations for the training

o July 21-30, 2023 – conduct of the training; begin writing the draft guidelines.

2. Second Deliverable: Draft Guidelines on the TJR mandate of BHRC; Report outlining the results of the training and action plan (Second instalment payment: 40%)

o August 1-5, 2023 – preparations for the workshop on drafting the guidelines.

o August 6-15, 2023 – Workshop on drafting the guidelines.

o August 16-30, 2023 – submission of draft guidelines

o September 1-10, 2023 – validation meetings with BHRC and proofreading of the guidelines.

3. Final Deliverable: Finalized guidelines and Final Report outlining results of the workshop and engagement (Final Instalment payment: 30%)

o September 11-30, 2023 – submission of guidelines for IOM review

o October 01-15, 2023 – Final version ready for turn-over to BHRC; start of M&E activities.

o October 16-29, 2023—Final report of completion

o October 30, 2023 – end of contract

The Consultant may be required to attend online or in-person meetings with the IOM project team and/or stakeholders (such as the BHRC or other relevant partners) on an ad hoc basis, to provide updates on deliverables and to ensure alignment with other project components. The Consultant may also need to travel to BARMM to support the conduct of some project activities.

Performance indicators for evaluation results

  • Quality and timeliness of the expected deliverables (value of services rendered in relation to their cost)
  • Effective adaptation of thematic resources and information into materials and key messaging that are relevant to the target audience.
  • Application of a results-based approach to the consultancy – i.e. deliverables are aligned with project objectives and contribute concretely to the overall impact of the project
  • Efficient coordination with the project team and all necessary stakeholders
  • Strict adherence to ethical standards, including confidentiality and data protection.

Required Qualifications and Experience

  • Strong background in policy development and planning with local governments.
  • Strong technical knowledge on Transitional Justice and Reconciliation in the Philippines
  • Excellent writing and organizational skills; proven capacities in community organizing, capacity-building, and stakeholder coordination.
  • Ability to engage with a wide range of stakeholders, from grassroots level to national policymakers.
  • Prior advocacy or research experience on conflict prevention, internal displacement, or migration is desirable.
  • Relevant educational background in the Social Sciences, Public Administration, Law, Peace and Conflict Studies, or Community Development; or academic background in any field combined with relevant specialized experience.
  • Experience/familiarity with policies and practices of intergovernmental organizations or international NGOs is preferred.

Languages

For this position, fluency in English and Filipino is required.

Knowledge of another BARMM local language is desirable.

Note

The consultant must adhere to the International Organization for Migration (IOM) Data Protection Principles (IN/138) and maintain confidentiality.

The consultant will be responsible to follow IOM writing guidelines and latest glossaries in all given assignments for accurate translation.

IOM is an intergovernmental organization, and as such is exempted of all taxes in the Philippines. Therefore, it is not obligated to retain any taxes that should be owed to the Government of the Philippines as part of the execution of this contract. It is the sole responsibility of the contractor to comply with any fiscal obligations that might be applicable.

The ownership of intellectual products developed during this project will be shared with the government entities partaking in its creation, as well as IOM’s regional office. Government agencies and the cooperating agency must be warranted visibility and recognition, through the use of their logos in every document and any other material that might be a result of these intellectual production. Applications received later or that do not specify the name of the call will not be considered.
