Context:

In 2023, IOM Philippines launched the Mainstream: Fair and Ethical Recruitment into the Philippines’ Migration Governance project (Mainstream), funded by the Government of Canada. The Mainstream project aims to build institutional capacity of the Department of Migrant Workers (DMW) to effectively engage with the governments of destination countries, business enterprises/chambers of commerce and private sector organizations, and select private recruitment agencies (PRAs) in the Philippines, in support of capacity-building efforts towards mainstreaming fair and ethical recruitment standards in line with the UN Guiding Principles on Business and Human Rights (UNGPs), the OECD Due Diligence Guidance for Responsible Business Practice and IOM’s Migrant Worker Guidelines for Employers.

Mainstream aims to promote multi-stakeholder engagement by leveraging consultations and coordination meetings under the proposed project as an avenue to further raise awareness on fair and ethical recruitment of overseas Filipino workers (OFWs), secure buy-in and facilitate continuous discussions to promote ethical recruitment due diligence among private sector stakeholders, and further identify and address challenges to implementing fair and ethical recruitment in accordance with international standards. This will be done by utilizing the Fair and Ethical Recruitment Due Diligence Toolkit (IOM DD Toolkit) – a new, open-sourced Toolkit, which was launched last November 2022, which is designed to support business enterprises in implementing due diligence to prevent and mitigate adverse human and labour rights impacts on migrant workers that are associated with recruitment arrangements and practices.

Nature of Consultancy: For this output, a consultant is needed to support the enhancement of DMW’s capacity-building initiatives to improve ethical recruitment practices among private recruitment agencies deploying migrant workers from the Philippines. The DMW’s existing capacity building programmes will be redesigned, factoring in inputs from multisectoral stakeholder consultations, to integrate fair and ethical recruitment and due diligence in line with the UNGPs and OECD Guidance. IOM seeks a consultant who will facilitate consultations with stakeholders, review the existing training programmes, work with the IOM team to create a complete training package consisting of a revised set of training modules with stronger emphasis on international ethical recruitment standards and a set of monitoing and evaluation tools to measure trainees’ increase in knowledge and understanding, and roll out a Training of Trainers to government partners.

IOM Project to which the Consultancy is contributing: Migration Management Unit (MMU) in IOM Philippines through the Mainstream project.

Tasks to be performed under this contract:

Under the direct supervision of the MMU Programme Manager and in close coordination with PSE and LMI Divisions under MMU, under the overall supervision of the Head of Programmes of IOM Philippines, the selected consultant will produce the following deliverables:

I. First set of deliverables: Multisectoral stakeholder consultations

In coordination with IOM, provide support to conduct a minimum of two consultation workshops to: (1) gather inputs and feedback from the PRAs on the current training programmes being offered by DMW and assess their training needs and recommendations for future capacity-building; and (2) to validate the proposed revised set of training materials

Consultations to be organized in person within January to March 2024

II. Second set of deliverables: Review of existing DMW training programme for PRAs and outline of revised modules

a) Production of a brief report summarizing key findings for enhancement of the existing training modules of the DMW, primarily for the Continuing Agency Education Program (CAEP), drawing on recommendations from the private sector stakeholders consulted.

b) Development of a proposed outline for the new modules, including additional module/s on ethical recruitment due diligence

III. Third set of deliverables: Revised training modules for PRAs, including on Ethical Recruitment Due Diligence, and M&E Tools

a) In coordination with IOM, create a revised set of training modules integrating due diligence for PRAs in DMW’s training programme under CAEP (and that can potentially be adapted for integration into other capacity-building programmes). This should incorporate feedback and recommendations from consultations with the private sector to validate the structure and content on draft modules, and should include specific component/s on Ethical Recruitment Due Diligence and operationalization of international standards on fair and ethical recruitment.

b) Create a set of M&E Tools to measure learning progress of training participants (i.e., PRA focals who would attend DMW’s future CAEP programmes). These should enable measurement and documentation of the participants’ increase in knowledge, as well as their readiness to apply the new knowledge gained in their work.

IV. Fourth set of deliverables: Conduct of the ToT on the revised modules

In coordination with IOM, rollout at least two Training of Trainers (ToT) sessions for focal persons from the Department of Migrant Workers (and/or other relevant government offices) on the developed modules and tools

ToT sessions to be conducted in person within March to first week of April 2024

  • Required deliverables are submitted/completed at the agreed-upon deadlines.
  • Submitted outputs are complete, accurate, and understandable.
  • Issues raised are resolved amicably with outcomes accepted by involved parties.

  • Quality and timeliness of the expected deliverables (value of services rendered in relation to their cost).
  • Active facilitation of development of tools
  • Efficient coordination with the project team and all necessary stakeholders (i.e. DHSUD, DSWD)
  • Strict adherence to ethical standards, including confidentiality and data protection.
  • Draft/Signed memorandum on the utilization of the Manual of Procedures

Required Qualifications and Experience

  • Minimum of a completed University degree (Masters degree/units desirable), preferably in Social Sciences, Labor Relations, Management, and/or in other related fields.
  • Prior work experience in creating training modules and working on issues or initiatives related to fair and ethical recruitment of migrant workers, business and human rights, corporate due diligence, and/or labor migration in the Philippine context is essential
  • Equipped with training skills; ability to work independently.
  • Demonstrated work experience with IOM and/or the United Nations, and experience in engaging with stakeholders in migration governance and/or corporate due diligence, is an advantage.
  • Excellent coordination and time management skills and ability to produce outputs as per agreed timelines.
  • Strong presentation, oral and written communication skills, and writing skills in English (submission of writing samples will be required from shortlisted candidates).

Languages

For this position, fluency in English and Filipino is required.

The consultant must adhere to the International Organization for Migration (IOM) Data Protection Principles (IN/138) and maintain confidentiality.

The consultant will be responsible to follow IOM writing guidelines and latest glossaries in all given assignments for accurate translation.

IOM is an intergovernmental organization, and as such is exempted from all taxes in the Philippines. Therefore, it is not obligated to retain any taxes that should be owed to the Government of the Philippines as part of the execution of this contract. It is the sole responsibility of the contractor to comply with any fiscal obligations that might be applicable.

The ownership of intellectual products developed during this project will be shared with the government entities partaking in its creation, as well as IOM’s regional office. Government agencies and the cooperating agency must be warranted visibility and recognition, through the use of their logos in every document and any other material that might be a result of these intellectual production. Applications received later or that do not specify the name of the call will not be considered.
