This position has been designated at the GS-14 equivalent level; D.C. locality pay ($126,233$164,102). Final compensation will be negotiated within the listed market value based upon qualifications, previous relevant work experience and work history, salary and education background. Salaries over and above the pay range will not be entertained or negotiated. Offerors who live outside the Washington, D.C. area will be considered for employment, but no relocation expenses will be reimbursed.

SECTION II: STATEMENT OF DUTIES

A. INTRODUCTION/BACKGROUND

The Office of the General Counsel (GC) provides legal advice, counsel, and services to the Agency and its officials and ensures that USAID programs are administered in accordance with legislative authorities. GC serves as the Agency’s chief legal officer and is the principal advisor to the Administrator on Agency-wide policy matters. GC also advises on legal matters concerning the operation and administration of USAID programs, and on matters relating to legislation or proposed legislation affecting USAID. The Office of General Counsel, Ethics and Administration Division (EA), Employment Law Team, provides labor and employment advice to Agency supervisors and managers.

The incumbent provides legal advice, guidance, and opinions on labor and employment laws and regulations applicable to federal employees and staff, including but not limited to: Title VII of the 1964 Civil Rights Act, the Age Discrimination in Employment Act, The Rehabilitation Act/The Americans with Disabilities Act, Title 5 of the United States Code, and the Foreign Service Act of 1980. The incumbent also represents USAID in third party administrative proceedings.

A. DUTIES AND RESPONSIBILITIES

With minimal supervision from the Deputy Assistant General Counsel for Employment, the incumbent provides legal advice, guidance, and opinions to the Assistant to the Administrator, Office of Human Capital Talent Management, The Director of the Office of Civil Rights and the Office of the Chief Diversity Officer, and subordinate staff on a day-to-day basis regarding all phases of personnel operations and assists in drafting policy for all aspects of personnel management such as appointment and assignment of personnel to domestic or overseas posts, employment of experts and consultants, separation and disciplinary actions, and training. With minimal supervision, the incumbent provides legal advice and guidance on labor and employment laws and regulations applicable to federal employees and staff, including but not limited to: Title VII of the 1964 Civil Rights Act, the Age Discrimination in Employment Act, The Rehabilitation Act/The Americans with Disabilities Act, Title 5 of the United States Code, and the Foreign Service Act of 1980.

Assignments include representing the Agency in administrative hearings before the Foreign Service Grievance Board, the Merit Systems Protection Board, The Equal Employment Opportunity Commission and other administrate fora. The incumbent addresses difficult and complex legal issues lacking clearly applicable precedents. Prepares the necessary legal papers for submission to Administrative Judges and panels and is the liaison with the Office of Personnel Management and the GAO on matters affecting USAID personnel operations in Washington and overseas. The incumbent exercises considerable independent judgment in determining the application of current legal and regular provisions and case law to assigned responsibilities.

B. SPECIFIC DUTIES

Attorney Advisor:

  • Act with independent judgment to develop the litigation strategy to defend the Agency in third party adjudicative proceeds in labor and employment matters.
  • Act with independent judgment to execute the litigation strategy to defend the Agency in third party adjudicative proceeds in labor and employment matters.
  • Provide advice on complex labor law matters.
  • Provide advice on complex employment law matters.
  • Serve as expert in Title VII of the 1964 Civil Rights Act, the Age Discrimination in Employment Act, The Rehabilitation Act/The Americans with Disabilities Act, to advise agency supervisors, managers and staff of the Office of Civil Rights and the Office of the Chief Diversity Officer.
  • Serve as expert in Title 5 of the United States Code, and the Foreign Service Act of 1980.
  • Serve as a liaison between the Department of Justice and USAID in Federal District Court employment claims.
  • Clearly articulate the Agency’s legal position during oral presentation before third parties.
  • Clearly articulate the Agency’s legal position during written briefs and memos before third parties.
  • Provide written and oral legal opinions to clients in a clear and concise manner that takes into consideration their limited understanding of legal matters.
  • Collaborates with team members effectively and cooperatively.

D. SUPERVISORY RELATIONSHIP

The position will receive direction from and report to the Deputy Assistant General Counsel for Employment (GC/EA). The incumbent is still expected to work independently in carrying out his or her responsibilities. Under the general guidance of the supervisor, the incumbent independently plans, designs, and carries out responsibilities; develops a legal strategy; provides legal advice and guidance on the interpretation and implementation of laws, regulations, and policies; responsible for planning their approach or methodology to be used in carrying out assignments; and takes initiative to carry out other legal experience relevant to the job duties above.

E. SUPERVISORY CONTROLS

Supervisor sets overall objectives. The incumbent and supervisor together will develop deadlines, projects and work to be done. The incumbent will not supervise any personnel but may provide direction to law student interns and paralegal staff.

F. WORK ENVIRONMENT AND PHYSICAL DEMANDS

The work environment involves everyday risks or discomforts that require normal safety precautions typical of offices, meeting rooms, and courtrooms (e.g., use of safe work practices with office equipment, avoidance of tripping and falling, and observance of fire regulations). The work area is adequately lighted, heated, and ventilated. This position will be at least part time telework eligible.

SECTION III: MINIMUM QUALIFICATIONS REQUIRED FOR THIS POSITION

  1. General: Must be a U.S. citizen and must be eligible to obtain a U.S. Government “SECRET” security clearance.

  2. Education: Minimum of Law degree from a University accredited by the American Bar Association, be a member in good standing of a State bar and a minimum three years legal experience, practicing labor and employment law including litigation.
