TERMS OF REFERENCE

Job Title: Social Safeguarding and Community Engagement Specialist (International)

Purpose: This role will be responsible to:

(i) Secure implementation of Land Acquisition and Compensation Support Program (LACSP) for phase 1 land and property acquisition;

(ii) Conduct survey, prepare and implement the LACSP for phase 2 land and property acquisition;

(iii) Supervise and support the conduct of community engagement by National Community Engagement Specialist.

Reporting to: Director General, DGMMER through IPMU Manager, and Director National of Public-Private Partnership (DNPPP) as necessary

Counterpart(s): Key staff at DGMMER, DNPPP, IPMU and others as assigned by Manager /Director

Location: IPMU for Presidente Nicolau Lobato International Airport, Dili, Timor Leste

I. BACKGROUND OF THE PROJECT

The Government of Timor-Leste has requested Asian Development Bank (ADB) assistance for Stage 1 of the expansion of President Nicolau Lobato International Airport (PNLIA). The proposed President Nicolau Lobato International Airport Expansion Project (the Project) will involve (i) extension of the existing 1,850 m runway to 2,100 m1, including a 166 m seaward extension; (ii) runway widening from 30 m to 45 m, and increase of runway strip protection width from 150 m to 280 m; (iii) new taxiways with dimensions to cover Code C aircrafts; (iv) reconfiguration of aprons; and, (v) relocation of the air traffic control tower. The Executing Agency (EA) of the project is the Council for the Administration of the Infrastructure Fund (CAFI) and the Implementing Agency (IA) is the Ministry of Transport and Communications (MOTC).

In addition to ADB financing, the development of the Project will come from different sources, including – (i) JICA Grant for the terminal components and (ii) Government counterpart financing to complement ADB financing and to cover VIP terminal as well as other sources of financing from Department of Foreign Affairs and Trade (DFAT) Australia and the World Bank to cover other components and the next phases of the development. Operation and management of the upgraded infrastructure will be contracted out to the private operator through a Public Private Partnership (PPP) arrangement with the PPP feasibility study and transaction structuring being prepared in parallel with the development.

For the purpose of overseeing the implementation the project, the Inter-Ministerial Committee (IMC) for the PNLIA development has decided to create a dedicated Integrated Project Management Unit (IPMU), to be established and staffed for that purpose. The IPMU is an implementation structure with temporary nature, created by the Government and report directly to the inter-ministerial commission, to undertake the technical and management of the execution of the PNLIA development project in all its components and phases. The IPMU will be staffed with personnel from relevant agencies and national and international professionals in technical/financial/legal and social/environmental aspects who will attend to the day-to-day aspects of PNLIA development including preparation of procurement processes, recruitment of consultants, contract management as well as actively involved in the preparation of the PPP transaction.

II.Selection Criteria

Essential

1.Master degree, or equivalent in community development, anthropology, Sociology or other related fields;

2.At least 10 years’ experience in land acquisition and/or resettlement plan preparation, implementation and addressing land and property acquisition issues for development projects in the South East Asia Region;

3.Knowledge of ADB Safeguard Policy Statement 2009 and IFC Performance Standards 2012 is required;

4.Demonstrated excellent understanding and proven working experiences of these following technical areas – preparation and conduct of Inventory of Losses (IoL) survey, preparation and conduct of Socio-Economic Survey, preparation of social safeguarding documents within the context of ADB SPS and IFC PS;

5.Demonstrated excellent understanding of preparation of Stakeholder Engagement Plan (SEP)/Stakeholder Communication Strategy (SCS) within the context of ADB SPS and IFC PS;

6.Some knowledge of Infrastructure Development and Planning, Budgeting and Public Financial Management in Timor-Leste;

7. Excellent communication and interpersonal skills;

Desirable

1. Ability to use GPS tracking system, Geographic Information System (GIS) software

2.Readiness to work with other international/national staff with multi-cultural backgrounds

3. Knowledge of Portuguese and Tetum and/or Bahasa Indonesia

III. Scope of Work

DUTIES AND RESPONSIBILITIES | PERFORMANCE INDICATOR 1.Brief the executing agency (EA), participating local government(s), and implementing agencies (IAs) on the Project resettlement policy; provide capacity-building support as needed 1.1. Project policies are incompliance with international rules and regulations. 1.2.Ensure the effectiveness of capacity-building support provided. 1.3.Good coordination with relevant agencies for the implementation of LAR.

2.Support the Joint Committee for Land Acquisition and Compensation (JCLAC) in updating the phase 1 LACSP, including carrying out meaningful consultations with affected households (AHs) and integrating the findings of the replacement cost study (RCS) and final decision on compensation cost from COM. 2.1.Phase 1 LACSP is finalized according to applicable Safeguarding Standards and Government’s decision. 2.2.All consultations are fully documented and reported in quarterly internal monitoring reports.

3.Support the JCLAC in carrying out surveys and studies required to verify the identified land and property acquisition impacts and assess the adequacy of proposed mitigation measures and/or other measures to ensure that affected households are not disadvantaged by project investments. 3.1.Analysis and critical reports are prepared with findings discussed with JCLAC. 3.2.Reports are timely submitted to the IPMU manager. 3.3. Implementation of LACSP conducted according to plans, addressing required actions.

4.Assist JCLAC in designing a detailed income restoration programs for severely affected and vulnerable AHs. Provide guidance in implementation of the same; 4.1.Effective guidance provided to the vulnerable AHs.

5.Support the National Community Engagement Specialist in disclosing the updated LACSP to affected communities and general public/interested parties in a form and language that are easy to understand and in an easily accessible place, before submission to ADB for approval. This can be in a form of a public information booklet (PIB), a summary LACSP or a complete LACSP. 5.1. LACSP is effectively and comprehensively disclosed to the affected communities; 5.2. The PIB or summary LACSP will clearly state that copies of complete LACSPs (both in English and Tetum) are available to the public and can be obtained from the Suco or Aldeia offices;

6.Assist JCLAC to review progress reports and monitor involuntary resettlement safeguards compliance of LACSP and project implementation. 6.1.Ensure the effectiveness of the project implementation and the incompliance with Govt. regulations and policies related to community and stakeholder engagement are secured. 6.2.Prepare quarterly internal monitoring reports 6.3.Accurate and timely submission of project review report.

  1. Alert to the Manager of IPMU and the EA to any land acquisition issues that arise during project implementation, draft corrective action plan(s) as necessary, and assist the EA in preparation of quarterly internal monitoring reports. 7.1.Ensure all issues are fully documented and reported in quarterly internal monitoring reports

8.Prepare quarterly internal monitoring reports. 8.1.Accurate and timely submission of project review report.

  1. Support ADB project review mission by conducting a prior spot check of the project, document findings, and participate in review missions.

9.1. Timely submission of project review report.

  1. Perform other task within the context of the social safeguarding works assigned by IPMU manager 10.1.Level of responsiveness to other requests. 10.2.Timeliness and quality of responses.

IV. Key Deliverables

In accordance with the performance indicators listed above

  • Within four weeks of commencement, develop an Activity Work Plan that is consistent with the relevant activities and performance indicators of the Ministry’s 5 Year Plan and submitted to the Manager of IPMU for approval;
  • Updated LACSP and LACSP addendums(s)[1]as required;
  • Capacity-building plans, as needed;
  • Documentation of capacity-building activities/trainings carried out;
  • Documentation of consultations with AHs and other stakeholders;
  • Quarterly internal social monitoring reports;
  • Corrective action plan(s) as needed.
  • Monthly and Quarterly Progress Reports to the Manager of IPMU against the agreed Work Plan;
  • End of Assignment report to Manager of IPMU no later than 10 working days prior to the end of contract.

V. Performance Evaluation

The performance of the incumbent will be appraised and evaluated by the Manager of IPMU, DGMMER using the Performance Appraisal System put in place and monitored by the National Directorate of Human Resource (NDHR), GDCS, and Ministry of Finance. This process will include a probation review within two (2) months of the commencement of the contract, regular reporting, ongoing workplace communications and annual performance appraisal. Performance indicators are in place for all areas within the Ministry, and the incumbent’s work will be contributing to the achievement of the priorities as set out in their TOR and in the Ministry’s Five Year Plan.

[1] RP addendum will be required to cover any unanticipated land acquisition and resettlement impacts that were not identified during preparation of the draft and updated RP (e.g., based detailed engineering design).
