OBJECTIVES:

The objective of this consultancy is to develop a Law of Ukraine on “The General Principles of Housing Policy”.

The Norwegian Refugee Council (NRC) is seeking to identify four National Legal Experts (national context) to form a team developing the Law of Ukraine on “General Principles of Housing Policy” through the provision of expert legal analysis, technical inputs, coordination, research and with a direct engagement with the Ministry of Communities, Territories, and Infrastructure Development.

The team of experts should be formed in a way that assigns specific responsibilities for each member of the team, including:

1. National Expert (focal point/team lead): Coordination of work on the drafting of the law; leading the working group, drafting the text of the law

2. National Expert (international context): Overview and analysis of international practice; drafting the text of the law

3. National Expert (national context): Analysis of the Ukrainian legislative framework; drafting the text of the law

4. National Expert (national context): Government relations expertise; communication and consultation with stakeholders, members of the parliament and committees of the Verkhovna Rada of Ukraine, state authorities; collection and analysis of comments; lobbying for the position of the Ministry of Communities, Territories, and Infrastructure Development; media support for changes in legislation to convey the relevant benefits to citizens.

PURPOSE OF THE CONSULTANCY:

In order to achieve the objective of this consultancy – to develop the Law of Ukraine on “General Principles of Housing Policy” – the four National Legal Experts (national and international context) will be required to:

· Develop a detailed Work Plan specifying concrete deliverables and timelines.

· Establishment of a working group in close coordination with the Ministry of Communities, Territories, and Infrastructure Development and key stakeholders.

· Develop the logical structure of the new law and outlining its main provisions.

· Engage in a process of approval of the logical structure of the new law, collect comments from experts, the public, international organizations, and clusters.

· Review comments, international practice and analysis of international standards.

· Develop the draft text of the new law.

· Analyse provisions of related regulatory framework.

· Compile a list of regulatory frameworks items.

· Engage in a process of approval of the text of the law with key stakeholders, including international organizations and clusters.

· Finalize the text of the law.

· Seek agreement of the final text of the law with the related ministries and other executive authorities, and through public discussions.

· Incorporate suggested amendments to the text of the draft law;

· Prepare the final text of the law for submission to the Ministry of Communities, Territories and Infrastructure Development.

· Provide support at the stage of adoption of the law, to include preparation of analytical reports, letters, infographics, etc.

· Update the list of related legal acts;

· Coordinate and work with a proposed International Legal Expert (International Context) to ensure that the draft law is informed by best practices of EU countries with progressive housing legislation.

Awarding Criteria:

1. A technical proposal including scope of work, applicant’s earliest date of availability to undertake assignment, and a proposed work plan that includes methodology (maximum 6 pages). 30%

2. Demonstration of Capability: For example, the CV of the lead consultant/s and, if quoting for an organization or consultant group, attach the CV of any other personnel to be involved in the assignment and certificate of registration. A list of previous work done (Work Completion Certificates can be attached) including telephone and email contacts of three (3) referees who can validate technical expertise. A report of a similar assignment carried out by the lead consultant. 30%

3. Financial proposal quoted in the form of a lump sum covering both your professional fee and overhead costs needed to meet the objectives of this assignment. 40%

· The RFQ number shall be inserted in the Subject Heading of the email

· Bid documents required, shall be included as an attachment to the email in PDF, JPEG, TIF format, or the same type of files provided as a ZIP file. Documents in MS Word or excel formats, will result in the bid being disqualified.

· Email attachments shall not exceed 4MB; otherwise, the bidder shall send his bid in multiple emails.

· Failure to comply with the above may disqualify the Bid.

It is NRC requirement that all consultants, ltd or sole-trade, must be registered in accordance with the legal requirements at their base. The consultant must be able to submit documentation that proves that they are meeting all legal and tax obligation for the consultancy. If this is not possible, the consultant (sole trader) confirms by signing the Consultant declaration (Mandatory) that he/she complied with self-employment regulation in his/her country of origin.

Conditions of quotation:

Payment will be made upon receipt of satisfactory deliverables as detailed in Annex 3, certified by NRC Procurement representative.

All suppliers doing business with NRC should maintain high standards on ethical issues, respect and apply basic human and social rights, ensure non-exploitation of child labour, and give fair working conditions to their staff. NRC reserves the right to reject quotations provided by suppliers not meeting these standards.

Vendors doing business with NRC will be screened on anti-corruption due diligence before NRC confirmed and order or contract.

NRC aims to purchase products and services with the minimum environmental impact. Environmental considerations form part of the NRC selection criteria, and NRC reserves the right to reject quotations provided by suppliers not meeting these standards.

Currencies of bid and payment

All prices shall be quoted by the Bidder in UAH. Similarly, all payments will be made in UAH.
