Overview & Responsibilities

BACKGROUND

The Ease of Doing Business Report published annually by the World Bank measures the ease of businesses within a particular economy. This is measured through indicators such as the time to set up companies and the ability to enforce contracts, among other factors. In the 2020 Ease of Doing Business Report, Kenya was ranked at position 56 out of 190 economies. Specifically, Kenya was ranked position 89 under the ease of enforcement of contract indices. These indices measured the cost incurred in filing a case, advocates fees, and auctioneers’ fees; (ii) the time taken to dispense with the matters; and (iii) the effectiveness and efficiency of judicial processes as automated.

To increase Kenya’s ease of doing business ranking, the Judiciary implements its Digital Strategy that focuses on e-justice and automation of judicial processes such as e-filing, e-payments, e-registries, court recording, and transcription, virtual court hearings, among others. In June 2022, the Judiciary’s Integrated Case Management Systems (ICMS) Committee reviewed the status of implementation of the Judiciary Digital Strategy and identified the need to enhance the capacity of courts and litigants to access and effectively use the automated platforms through the development of utility tools, training, coaching and mentorship of users.

THE ASSIGNMENT

To enhance the capacity of courts and litigants to use the automated processes, the Judiciary and Kenya Judiciary Academy, in partnership with IDLO, seeks to engage a consultant to review the e-filing processes and develop Guidelines and Training Curriculum on e-filing for the Judiciary.

The Consultant’s responsibilities will include to:

Undertake a comprehensive gap analysis of the e-filing processes through consultations with internal and external e-filing users.

  1. Informed by the gap analysis findings, develop Guidelines and Training Curriculum on e-filing, using a participant-centred training methodology.
  2. Present the draft Guidelines and Training Curriculum on e-filing during various stakeholder meetings, including but not limited to the Judiciary ICT Directorate ICMS Committee, KJA, and LSK.
  3. Incorporate feedback from the stakeholders’ consultations and finalize Guidelines and Training Curriculum on e-filing for presentation to the Judiciary ICT Directorate, ICMS Committee, KJA, and IDLO.
  4. Deliver the final Guidelines and Training Curriculum in a Shareable Content Object Reference Model format, to be imported into the KJA e-learning platform.
  5. Conduct the first pilot training of judicial officers and staff on e-filing, using the developed Guidelines and Training Curriculum on e-filing.

DELIVERABLES

  1. An Inception Report detailing the understanding of the assignment, methodology, timelines, and work plan, within the first 7 days of the assignment.
  2. A comprehensive Gap Analysis Report on the e-filing process within 30 days of the assignment.
  3. A final draft of the Guidelines and Manual on e-filing within 60 days of the assignment in a format that is uploadable in the KJA e-learning platform.
  4. An Assignment Completion Report and sources of information relied upon for the development of the guidelines and manual within 75 days of the assignment.

Job Requirements

IDEAL CANDIDATE PROFILE

The Consultant should have the following skills, qualifications, and experience:

Education

  • Bachelor of Fine Arts in Graphic Design with specialization in Graphic Design or related discipline from an institution recognized in Kenya.
  • Post-graduate professional qualifications in the fields above will be an added advantage.
  • A strong portfolio of illustrations or other graphics
  • Familiarity with design software and technologies such as In Design, Illustrator, articulate, Photoshop
  • Certifications in any other design software will be an added advantage
  • A keen eye for aesthetics and details
  • A proven record in developing a curriculum and digitizing an institution’s course content will be an added advantage.
  • Ability to work methodically and meet deadlines
  • Able to give and receive constructive criticism.

Work experience

  • Demonstrated knowledge and experience in course content digitization.
  • Demonstrated experience in offering professional ICT training, peer-to-peer learning, or mentorship for users.
  • Demonstrated skills and experience delivering on similar or related assignments, including proof of training guidelines, manuals, and curricula developed.
  • Sound knowledge of automation of judicial processes, including the applications currently employed by the Judiciary for e-justice platforms.

Technical competencies

  • Excellent organizational, interpersonal, and communication skills.
  • Excellent work ethic founded on the principles of integrity and confidentiality.
