ORGANISATIONAL CONTEXT

The International Development Law Organization (IDLO) enables governments, empowers people, and strengthens institutions to realise justice and promote peace and sustainable development. THE ASSIGNMENT

Within its Enhancing the Institutional Capacity of Prosecutors of the Philippines project, IDLO is looking to partner with the Philippines Department of Justice (DOJ) and the Anti-Money Laundering Council (AMLC) and conduct Institutional Learning Needs Assessments (ILNA) for the DOJ National Prosecution Service (NPS) and the Anti-Money Laundering Council Secretariat (AMLCS).

For the above, IDLO will retain the services of a Legal & Judicial Education Specialist who will conduct an ILNA, develop data gathering tools, review available documents, facilitate the activities, analyse data gathered, summarise findings, and make recommendations in relation to the institutional learning needs of both partners.

Reporting to the Philippine Country Manager and working closely with the Field Programme Coordinators for DOJ and AMLC, the consultant will be responsible for undertaking the following:

  1. The consultant will prepare for and administer the ILNAs:

For the AMLCS:

Focus Group Discussions (FGDs) and Key Informant Interviews (KIIs) are as follows:

I. Directors and Deputy Directors (FGDs);

ii. Prosecution arms (AMLC task force heads and members from DOJ, OSG, and OMB);

iii. Case-related co-workers (CA justice, RTC and first-level court judges, law enforcers) (KII or agency-specific FGDs).

■ Survey of the current state of training (questionnaire on training and learning for legal officers and financial investigators).

■ Document review:

I. Training programme, training curriculum, training partnerships, training budget, trainers, training recipients;

ii. Organization and functions, position descriptions, case processes, case types, caseload and case-related information.

■ Interview of management (Bangko Sentral ng Pilipinas Governor, Securities and Exchanges Commission Chairperson, Insurance Commission Commissioner, or their representatives and AMLCS Executive Director).

For the DOJ-NPS:

■ Review of the ILNA completed in 2018 for the DOJ-NPS.

■ Focus Group Discussions (FGDs) and Key Informant Interviews (KIIs) are as follows:

I. Regional Prosecutors, City Prosecutors, Provincial Prosecutors, and Senior State Prosecutors (FGD);

ii. Trainers and participants of capacity building activities implemented since the 2018 ILNA;

iii. Case-related co-workers – Regional Trial Court and first-level court judges, Philippine National Police officers and Bureau of Jail Management and Penology (KIIs or agency-specific FGDs);

iv. Client (Criminal case party of a decided case).

■ Survey of the current state of training (questionnaire on training and learning for a purposive sample of prosecutors in all regions).

■ Document review.

i. Training programme, training curriculum, training partnerships, training budget, trainers, training recipients;

ii. Organization and functions, position descriptions, case processes, case types, caseload and case-related information.

■ Interview of management (DOJ Secretary, NPS heads, Heads of Planning, Human Resource, Budget, IT) – structured position/role specific KIIs.

  1. The consultant will prepare draft reports and validate the outcomes/findings of the report through a validation workshop with the respective key stakeholders of AMLCS and DOJ leaderships, and IDLO.

  2. The consultant will be expected at all times to coordinate closely with IDLO through regular coordination meetings.

KEY DELIVERABLES

 Two inception reports, one for AMLCS and DOJ-NPS each, were submitted to IDLO no later than 7 days after the commencement of the assignment. The inception report shall contain the following:

i. Assessment objectives;

ii. Proposed content;

iii. Methodology; and

iv. Workplan indicating clear milestones and timelines.

 Two draft reports, one for AMLCS and DOJ-NPS each, submitted by 31 July 2022.

 Participation in the validation workshops for AMLCS and DOJ-NPS reports is anticipated to be held on the 1st and 2nd week of August 2022.

 Two final reports, one for AMLCS and DOJ-NPS each, submitted by 31 September 2022 containing:

i. Executive Summary;

ii. Introduction and Background;

iii. Main findings related to the objectives of the assignment;

iv. Conclusions;

v. Key recommendations; and

vi. Relevant Annexes.

IDEAL CANDIDATE PROFILE

Education and Work Experience

  • A degree in law from the Philippines is required;
  • Minimum 8-10 years of relevant professional experience in legal and judicial education;
  • A solid background in Organizational Development and Human Resources Management, especially in the public sector, would be an advantage;
  • Previous experience in drafting interactive training modules, developing institutional training curricula, and conducting institutional learning needs assessments would be a considerable asset;
  • Experience working with the Department of Justice, the Anti-Money Laundering Council, or other justice sector institutions would likewise be an advantage;
  • Good understanding of the political and cultural dynamics of Philippine legislative sector Institutions.

Languages

  • Fluency in written and spoken English is required.

Specific Technical & Behavioral Competencies

  • Excellent written and verbal communication skills;
  • Proficiency in Microsoft Word, Excel and PowerPoint;
  • Excellent interpersonal skills; ability to work constructively with several internal service departments;
  • Proven ability to develop and foster remote working relationships;
  • Proven ability to see through set tasks and deliver results on time;
  • Ability to work under pressure with tight deadlines, flexibility and an entrepreneurial spirit;
  • Self-motivated and dynamic with a willingness and ability to use initiative;
  • Ability to take guidance, incorporate feedback, and consider various perspectives;
  • Keen sense of ethics, integrity, and commitment to IDLO’s mandate.

TERMS AND CONDITIONS

The Services will be performed home-based with face-to-face and virtual meetings with stakeholders and respondents. For this consultancy, IDLO shall offer the selected candidate a Single Engagement Agreement. The selected candidate is expected to start as soon as possible.
